1. About FitnessSwipe

FitnessSwipe is a mobile application that helps users find workout partners nearby. The service is operated by Sylwester Kamys ("we", "us", "our").

2. Eligibility

To use FitnessSwipe, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the service under applicable law
• Have a valid email address

3. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

4. Acceptable Use

You agree to use FitnessSwipe only for lawful purposes. You must NOT:

• Post false, misleading, or fraudulent information
• Use someone else's identity or photos
• Harass, threaten, or intimidate other users
• Send spam, unsolicited messages, or advertising
• Post sexually explicit, violent, or offensive content
• Attempt to gain unauthorized access to other accounts or our systems
• Use the app for commercial solicitation without our written consent
• Scrape or collect user data without authorization
• Use bots or automated tools to interact with the app
• Violate any applicable laws or regulations

5. Profile Content

You are solely responsible for the content you post. By posting content, you grant FitnessSwipe a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the app for the purpose of providing the service.

You confirm that you own all rights to the content you post and that it does not infringe any third-party rights.

6. Profile Verification

Profile verification is optional but encouraged. Verification photos are processed by AI to confirm identity and are never shown to other users. We reserve the right to remove unverified profiles that appear to be fake.

7. Matching and Communication

FitnessSwipe facilitates connections between users. We do not guarantee:

• That you will find a suitable workout partner
• The accuracy of other users' information
• The safety or behavior of other users

You are responsible for exercising caution when meeting other users in person. Always meet in public places for initial meetings.

8. Premium Subscription

FitnessSwipe offers a Premium subscription with additional features including unlimited swipes, undo functionality, Super Like, workout history with calendar, profile statistics, and the ability to see who liked your profile. Premium subscriptions:

• Are billed monthly, quarterly, or annually as selected
• Automatically renew unless cancelled at least 24 hours before the renewal date
• Can be managed and cancelled through your App Store or Google Play account settings
• Are non-refundable except as required by applicable law

9. Prohibited Content

This applies to all content you post, including profile photos, bio text, chat messages, and 24-hour status updates (photos or short videos). The following content is strictly prohibited and will result in immediate account termination:

• Nudity or sexual content
• Content involving or targeting minors
• Hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality
• Content promoting violence or illegal activities
• Spam or commercial advertising

Reporting and moderation: every status, photo, and video can be reported directly from where it appears in the app, in addition to reporting a user's profile. We review reports and remove content that violates these Terms, typically within 24 hours. Repeat or severe violations result in account suspension or termination. You can also block any user at any time, which immediately hides their content from you and yours from them.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time through the app settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

11. Originality and Independence

FitnessSwipe is an independently developed application. It was created without copying, reproducing, or deriving from any other application, platform, or software. Any similarity to other existing applications — in terms of name, functionality, design, or concept — is purely coincidental and unintentional.

The concept of connecting people for fitness purposes is a general, non-proprietary idea. FitnessSwipe's implementation, design, codebase, and features are original works created independently by the developer.

We respect all intellectual property rights and have made every effort to ensure that FitnessSwipe does not infringe upon any third-party trademarks, copyrights, or patents. If you believe there is an infringement, please contact us at support.fitnessswipe@gmail.com before taking any legal action.

12. Disclaimer of Warranties

FitnessSwipe is provided "as is" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. We are not responsible for the actions, content, or data of third parties.

13. Limitation of Liability

To the maximum extent permitted by applicable law, FitnessSwipe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Safety Guidelines

Your safety is important to us. We recommend:

• Always meet new partners for the first time in a public place (gym, park, etc.)
• Tell a friend or family member where you are going
• Trust your instincts — if something feels wrong, leave
• Report suspicious behavior using the in-app reporting feature
• Never share sensitive personal information (home address, financial details) with new matches

15. Governing Law

These Terms are governed by the laws of the Netherlands and applicable EU regulations. Any disputes shall be subject to the jurisdiction of the courts of the Netherlands.

15. Originality and Independent Development

FitnessSwipe is an independently developed application created from scratch. Any similarities to other applications, platforms, or services — including but not limited to names, features, user interface elements, or functionality — are coincidental and unintentional.

FitnessSwipe does not claim any affiliation with, endorsement by, or connection to any third-party applications or services that may offer similar features. The concept of connecting people for fitness activities is a general idea that exists in the public domain and is not proprietary to any single entity.

FitnessSwipe does not infringe upon any known intellectual property rights. If you believe there is an intellectual property concern, please contact us at support.fitnessswipe@gmail.com before taking any legal action, and we will address your concerns promptly.

16. Limitation on Third-Party Claims

To the maximum extent permitted by applicable law, FitnessSwipe shall not be liable for any claims arising from alleged similarities to other products or services. Users acknowledge that fitness-focused social matching applications represent a general category of software, and that no single entity holds exclusive rights to this concept.

FitnessSwipe reserves the right to modify any features, names, or elements of the application if notified of a legitimate intellectual property concern, without admitting liability.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via the app or email. Continued use of the app after changes constitutes acceptance of the updated Terms.
